We process your data based on: (a) contractual necessity for service delivery, (b) legitimate interest in improving our services, (c) consent for marketing communications, and (d) compliance with legal obligations. You may withdraw consent at any time without affecting the lawfulness of prior processing.

5. Data Retention

Personal data is retained for the duration necessary to fulfill the purposes for which it was collected. Client data is maintained for 5 years after the conclusion of business relations to comply with tax and accounting requirements. Marketing consent data is retained until withdrawal of consent.

Terms of Service

1. Agreement to Terms

By engaging BrandStoryPoint, located at Calle de la Granada 10, 29015 Malaga, Spain, for copywriting or marketing services, you agree to these Terms of Service. These terms constitute a binding agreement between you (the Client) and BrandStoryPoint (the Provider).

2. Scope of Services

BrandStoryPoint provides copywriting, content marketing, and campaign strategy services as described in individual service agreements. Each project scope, deliverables, timelines, and pricing are defined in a separate proposal or statement of work accepted by the Client.

Payment Terms

Invoices are due within 14 days of issue. A 50% deposit is required before project commencement. Late payments incur a 2% monthly surcharge. All prices are in EUR unless otherwise specified.

Intellectual Property

Upon full payment, all final deliverables become the exclusive property of the Client. BrandStoryPoint retains the right to display work in portfolios and case studies unless otherwise agreed in writing.

3. Revisions & Changes

Each service package includes up to two rounds of revisions at no additional cost. Additional revision rounds are billed at EUR 75 per hour. Changes to project scope after approval require a written change order with updated pricing and timelines.

4. Cancellation & Termination

Either party may terminate the agreement with 14 days written notice. Upon termination, the Client is responsible for payment of all work completed up to the termination date. Deposits are non-refundable for work already commenced.

5. Limitation of Liability

BrandStoryPoint's total liability shall not exceed the total fees paid by the Client for the specific service giving rise to the claim. We are not liable for indirect, consequential, or incidental damages, including loss of revenue or business opportunities.

6. Confidentiality

Both parties agree to maintain confidentiality of proprietary information shared during the engagement. This obligation survives termination of the agreement for a period of 2 years.

7. Governing Law

These terms are governed by the laws of Spain. Any disputes shall be resolved through arbitration in Malaga, Spain, in accordance with the rules of the Spanish Arbitration Council.

Refund Policy

1. Refund Eligibility

BrandStoryPoint, located at Calle de la Granada 10, 29015 Malaga, Spain, offers refunds under the following conditions: (a) if work has not commenced, a full refund minus administrative fees may be issued, (b) if work has commenced, a partial refund proportional to undelivered milestones may be considered, (c) if deliverables fail to meet agreed specifications after reasonable revision attempts, a refund may be issued at our discretion.

2. Non-Refundable Items

The following are non-refundable: (a) initial deposits for projects where work has already commenced, (b) completed and delivered work that meets agreed specifications, (c) third-party costs incurred on behalf of the Client, (d) rush order premiums, and (e) consulting fees for time already rendered.

Refund Request Process

Submit refund requests to [email protected] within 14 days of delivery. Include your project reference number and detailed reason for the refund request.

Processing Timeline

Refund requests are reviewed within 5 business days. Approved refunds are processed within 14 days to the original payment method. You will receive email confirmation of the refund.

3. Dispute Resolution

If you are unsatisfied with a refund decision, you may request a review by contacting our management team. Unresolved disputes may be submitted to mediation through the Malaga Chamber of Commerce before pursuing legal remedies under Spanish law.
